As we enter what we hope is going to be a year of far greater freedom for us all in 2021, it remains a worrying trend that many widows and widowers are losing their entire combined estate, consisting of theirs and their deceased spouses assets, to care fees. This INCLUDES the family home.
However, simply by structuring our Wills correctly during our lifetime, we can ensure that any widow or widower limits their exposure for care fees assessment solely to THEIR SHARE of the combined estate. The result being that their deceased spouse’s assets are fully protected for their ultimate desired beneficiaries, usually children.
The surviving spouse does not lose any use or benefit of their deceased spouse’s assets during their lifetime, and they do not experience any inferior care provision as a result
